An Indianapolis man has been charged for murdering his infant son’s mother moments after she dropped her children off at daycare.
Orlando Mitchell, 33, was charged Monday with murder, invasion of privacy and unlawful possession of a firearm by a domestic batterer.
Mitchell fatally shot Krystal Walton, 32, outside of Charity Child Care in Indianapolis on September 16.
The staff working and the children attending the daycare witnessed the tragic and horrifying shooting.
The killing happened around 7:30 a.m., as Walton was headed back to her car. The couple have a 1-year old son together.
Authorities stated, “We have body cam footage of Mitchell’s arrest showing him saying, ‘I shot that b–ch!’, and ‘I shot that b–ch in the face!'”
The suspect’s mother drove to the daycare after learning what her son did. Once there, she told police, “I have not spoken to my son in over a month after he threatened to kill Krystal and himself in a murder-suicide.”
She continued to tell police, “My son told me if he couldn’t see his son, she wasn’t gonna be in his life either.”
Mitchell’s mother assisted police by giving them a description of his vehicle, which was found around 10:20 a.m.
Mitchell was arrested after a brief standoff with police, which ended with officers shooting him.
The suspect was rushed to the hospital for treatment.
Mitchell has a past history for domestic violence. In March 2021, Mitchell was charged with strangulation, domestic battery, criminal confinement and intimidation, all after Walton called police saying Mitchell, her boyfriend at the time, assaulted her while she was four months pregnant with their son.
Walton told police Mitchell grabbed her by the hair and told her “He will f—king kill her, she needs to get rid of the baby and that she is going to make him kill her.”
Mitchell grabbed Walton by the hair as the daughter, who was six years old at the time, tried to intervene.
Walton told police Mitchell got her on the bed and started choking her while her daughter was still trying to intervene. Walton was able to get away and go to her mother’s house.
“Ms. Walton does believe he will try to kill her and is concerned he will come to her temporary location,” read the probable cause affidavit.
On July 26, 2022, Mitchell pleaded guilty to a lesser charge of domestic battery as a misdemeanor and prosecutors dismissed the remaining charges.
He was sentenced to 363 days in jail, but the sentence was suspended.
Mitchell was sentenced to one-year probation, 26-week domestic violence counseling or batterer’s intervention, a no-contact order for Krystal Walton unless the contact involved childcare for their son, and a substance abuse evaluation and any recommended treatment.
Mitchell violated the conditions of the agreement, according to the Marion County Prosecutor’s Office.
The court found Mitchell violated his probation and issued a warrant on August 30, 2022.
On September 15, prosecutors filed three additional charges against Mitchell for invasion of privacy, intimidation, and residential entry.
The charges stem from an August 6, 2022 incident.
Walton told police Mitchell she was scared for her life after Mitchell forced his way into her home even though Walton had a protective order against him.
I think not only he should to be charged for premeditated murder so should the prosecutor who dropped all those charges from the previous case that allowed him to be free. Easy way out for a prosecutor too lazy to do their job to protect the public.
