Texas Attorney General Ken Paxton was assisted by his wife, State Senator Angela Paxton, when he fled his home Monday morning to avoid being served a subpoena.
A process server said, “I parked outside the Paxtons’ home and knocked on the door in an effort to serve the Texas attorney general.”
“I could see a silhouette of a man walking in the living room area,” process server Ernesto Martin Herrera said in the sworn affidavit. “I knocked on the front door. The door had clear glass in it and I could clearly see inside the house. A female got up from the couch and started walking to the door. I saw Mr. Paxton enter the room behind her. When he saw me, he turned around and went back to where he came from. I recognized him as Ken Paxton from the many pictures available on the internet.”
Then Angela Paxton identified herself as Ken’s wife after opening the door and Herrera claims he explained to her that he was trying to deliver important legal documents to her husband.
Herrera said, “She went back towards the area where Mr. Paxton had gone and she came back telling me that he was on the phone. I offered to wait for him to be off the phone. She said that he was in a hurry to leave. I left my business card with her.”
“I went back to my car and waited for a little over an hour and that’s when I saw Ken exit the driveway. I walked up the driveway approaching Mr. Paxton and called him by his name. As soon as he saw me and heard me call his name out, he turned around and ran back inside the house through the same door in the garage,” Herrera continued.
A few minutes later, Herrera claims Angela came outside and opened the driver side and rear door behind the driver of a truck. She then got into the driver’s seat and started the truck, leaving the back door behind her open. A few minutes after that, Mr. Paxton ran from the door inside the garage towards the truck.
Herrera said, “I approached the truck and yelled loudly, calling Mr. Paxton by his name and stated I had documents for him. Mr. Paxton ignored me and kept heading for the truck. I realized at this point that he was not going to take the papers from me, so I said once again I was serving him legal documents and left them on the ground by the truck.”
The subpoena being served, was for Ken Paxton to testify at a hearing in a lawsuit filed by abortion rights groups, who want to prevent state prosecutors from prosecuting them for helping Texans seek access to legal abortions in other states.
Angela has not yet publicly responded to the controversy, though her husband, in a tweet sent Monday, didn’t dispute the report, “Just the media drumming up another controversy involving my work as Attorney General and attacking me for having the audacity to avoid a stranger lingering outside my home and showing concern about the safety and well-being of my family.”
Ken Paxton is no stranger to controversy. He was indicted on felony securities fraud charges just a few months after taking office as attorney general in 2015. He has pleaded not guilty and the trial has yet to take place.
In 2020, the Associated Press reported that the FBI was investigating claims that he had abused his office to help a wealthy donor. There, too, Paxton has denied wrongdoing.
Paxton has also courted controversy for taking a leading role in the failed Supreme Court case aimed at overturning the results of the 2020 election, which Joe Biden won over Donald Trump.

Since when are you obligated to answer the door of your home to a strange or anybody else for any reason? This process server is not a police officer with a warrant. By his own admission he was deceptive in claiming he just wanted to give Paxton some legal papers. Furthermore nobody is obligated in any way to respond to a stranger who is calling out to them. Maybe Paxton knew Herrera was trying to serve papers and so what. Paxton is accessible at his office. But at least the story did bring up the phony security charges that the partisan DAs refuse to bring to trial even after 7 years. If Paxton is so dirty why not act on those indictments? The way this story is written it sounds a lot like a hit job against AG Paxton and his wife.
Seems that he knew what was up. Quit being an apologist for someone dodging responsibility.
Democrats have dodged subpoenas many times . they have also just refused to show up , or just refused to answer any questions if they did show up . They have also destroyed evidence when it was subpoenaed . And no one said or did anything about it . But that never seems to be the case if it’s a conservative or republican . It’s called slective outrage . And as in most cases very selective outrage
I want to know what these cases you’re talking about are? I love when anybody says well Democrats did this and Democrats did that but never give proof. I can claim Donald Trump had sex with animals. Now more than likely that’s true but it’s just me saying it. Now I know that there are pictures of him and a chicken out there unfortunately I don’t have them available but the pictures do exist. So this is just an example of the kind of crap that is spewed out, primarily by Republicans, with absolutely no proof. And that’s the bottom line you want to talk crap than show some proof and then we can have a conversation. But if all you’re gonna do is make accusations then you know what go back into your mamas basement and play some video games. Or go out to your backyard and shoot your AR into our tree.
