Donald Trump has seemingly managed to delay another criminal trial, this time in his Georgia election subversion case, until well after the 2024 election.
The Georgia Court of Appeals issued an order on Wednesday, June 5, preventing Fulton County Judge Scott McAfee from moving forward with pretrial motions until a decision is made on Trump’s recent appeal.
Trump is challenging Judge McAfee’s decision to allow District Attorney Fani Willis to stay on the case despite her connection with one of her prosecutors.
Oral arguments for Trump’s appeal are tentatively set for October 4, with the court expected to deliver its ruling by March.
The losing side will have the option to escalate the issue to the Georgia Supreme Court, which would further delay the trial.
For months, it has appeared likely that only one of Trump’s four criminal cases would reach trial by November.
This case is in Manhattan, where Trump was recently convicted on 34 felony counts of falsified business records related to the 2016 presidential election.
In his federal classified documents case, Trump is charged with violating the Espionage Act, among other offenses.
The Trump-appointed judge in this case has indefinitely postponed the trial as of May.
His federal January 6 case, which includes a charge of conspiring to defraud the United States, is on hold until the Supreme Court rules on whether presidential immunity protects him from prosecution.
This ruling is expected in late June and is likely to result in the case being sent back to a lower court to narrow the scope of the trial.
Trump’s Georgia case involves a Fulton County grand jury indictment on 13 felony counts related to an alleged attempt to overturn the state’s 2020 election results.
Judge McAfee previously dismissed three of these charges, leaving Trump facing 10 felony counts, including a violation of the Georgia RICO Act.
While it was widely doubted that the Georgia case would go to trial before the election, the latest appeals court order confirms this delay.
If Trump wins the 2024 presidential election and returns to the White House, there is no precedent for handling his criminal cases. He could potentially order his Department of Justice to attempt to end or delay the federal cases, though state prosecution in Georgia would be more complex.
Legal experts suggest that any sentence from his Manhattan conviction, expected on July 11, would likely be suspended to allow him to fulfill presidential duties.
